Official Sweepstakes Rules 1. SPONSOR: The "Bosch Drift Into a Mustang Sweepstakes" (the "Sweepstakes") is sponsored by Robert Bosch LLC (Bosch), 2800 South 25th Avenue, Broadview, IL 60155. Ford Motor Company is not a sponsor of this sweepstakes. 2. ADMINISTRATOR: innovative Customer Management Solutions, Inc. (iCMS), P.O. Box 7060 , Troy, MI 48007-9615. 3. SWEEPSTAKES DESCRIPTION: The BOSCH DRIFT INTO A MUSTANG SWEEPSTAKES (the "Sweepstakes") is offered only in and may be entered only from the 50 United States and the District of Columbia ("U.S."). The Sweepstakes begins at 12:01 AM Eastern Daylight Time (EDT) on March 17, 2009 and ends at 11:59:59 PM, June 30, 2009. All eligible entries must be received on or before 11:59:59 PM, June 30, 2009 ("Sweepstakes Period"). 4. ELIGIBILITY: The Sweepstakes is open only to legal residents of the United States and District of Columbia ("U.S."), who possess a valid U.S. driver's license and are 18 years of age or older at time of entry. Employees, and their immediate families (spouses and siblings, parents and children and their spouses) and household members of Bosch ("Sponsor"), Ford Motor Company, Ford Racing, Team Detroit, iCMS and their respective affiliates, subsidiaries, divisions, dealers, advertising and promotion agencies ("Sweepstakes Entities") are not eligible. Void in Puerto Rico and where prohibited. 5. AGREEMENT TO THE OFFICIAL RULES: By participating in the Sweepstakes, each entrant fully and unconditionally accepts these Official Rules and the decisions of Sponsor and Administrator, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Noncompliance with the Official Rules will result in disqualification and the forfeiture of any prize. 6. HOW TO ENTER: There are two ways to enter the Sweepstakes: 1) INTERNET - Complete the online Sweepstakes entry form at www.boschperformanceart.com (the "Website") and submit as directed during the Sweepstakes period; or 2) MAIL - Enter by mailing a postage paid 3" by 5" postcard ONLY, to "Bosch Drift into a Mustang Sweepstakes", C/O innovative Customer Management Solutions, P.O. Box 7060, Troy, MI 48007-9615 during the "Sweepstakes period". On this postcard you must provide your complete name, address, city, state, zip code, daytime and nighttime telephone number, and/or email address and a statement that you are at least 18 years of age, possess a valid driver's license and that you have read and agree to the official rules. All mailed entries must be received on or before June 30, 2009. Limit of one entry per day regardless of method of entry used. Multiple entries generated by a script, macro or other automated means will be disqualified. In case of dispute as to the owner of an online entry, online entry will be deemed to have been submitted by the authorized account holder of the e-mail address from which the entry is made. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Entries that are incomplete or corrupted are void. Sponsor is not responsible for late, lost, illegible or damaged entries. Entries become the property of the Sponsor and will not be returned. 7. PRIZES/APPROXIMATE RETAIL VALUE (ARV): One (1) Grand Prize - a 2010 Ford Mustang GT, Ford Racing Performance Package (Ford Racing GT Coupe Handling Package, Ford Racing GT X-Pipe, Ford Racing Mustang Shaker Hood Scoop, Ford Racing GT Mufflers and $800 towards the installation of the Ford Racing Performance Package to be installed at the Ford Dealer where the vehicle will be delivered) , (1) Canvas Performance Art Poster autographed by Vaughn Gittin, Jr., Bosch Gear (to include (1) leather jacket and (1) rolling duffel), (1) set (up to 8) Bosch spark plugs and (2) Bosch wiper blades (ARV of total Grand Prize package-$34,609) will be awarded. One (1) First Prize - One (1) day with Vaughn Gittin, Jr. (at a location to be determined) learning how to drift. To include a trip for two (2) to a location to be determined including airfare, accommodations for one night (1 room with 2 double beds), $250 Gift Card which can be used for meals and ground transportation , (1) Canvas Performance Art Poster autographed by Vaughn Gittin, Jr., Bosch Gear (to include (1) leather jacket and (1) rolling duffel, (1) set (up to 8) Bosch spark plugs and (2) Bosch wiper blades. (Total ARV - $5,886). The trip must be completed on or before June 30, 2010. Prize package may include roundtrip coach class airfare for two (2) from a major airport near the winner's home if, in the judgment of sponsor air travel is required due to the winner's proximity to the event. Sponsor will determine flight itinerary and airline. Winner and travel companion must travel on same itinerary. No refund or compensation will be made in the event of flight delay or cancellation. Travel is subject to the conditions of the respective airline and airport. Winner and travel companion will be responsible for all other meals, incidentals, duties, fees, charges, parking, gratuities and all other expenses not specifically set forth herein. Winners are responsible for all taxes (federal, state and/or local) and any other expenses not listed, which relate to acceptance and use of prize, including, but not limited to insurance, maintenance and registration for Grand Prize. One (1) Second Place prize winner will also be selected each week during the Sweepstakes Period. A total of 15 Second Place winners will be selected during the Sweepstakes Period. Each weekly winner will receive one (1) set (up to 8) Bosch spark plugs and one (1) Bosch cap. (ARV $70) Winners may not transfer, exchange or redeem any Prize for cash. No substitution may be made, except by Sponsor, who reserves the right, in its sole discretion, to substitute a prize with another prize of comparable or greater value. All specifics are within the sponsor's sole discretion. Winners are solely responsible for any and all applicable fees and taxes. Grand Prize Winner responsible for all transportation costs once vehicle is delivered to Ford dealer selected by Sponsor. 8. WINNER SELECTION AND VERIFICATION: SELECTION AND NOTIFICATION: The winning Grand Prize and First Place entrant(s) will be selected at random from all eligible entries received during the sweepstakes period on or about July 10, 2009. The winning weekly entrants shall be selected each Tuesday during the sweepstakes period from all eligible entries received by the date of each drawing. The potential selected winner will be notified within 7 days of selection by email, phone, or other electronic means, at Sponsor's sole discretion. Any potential Prize Winner is not a winner until all required documentation, including, but not limited to an Affidavit of Eligibility, Publicity Release and Liability Release is received by sponsor and their eligibility has been verified. Such documents must be signed and returned by the date and/or time indicated within such documents. If a Sweepstakes representative is unable to contact the selected entrant within 3 days of their selection that entrant may be disqualified and an alternate entrant will be selected. All decisions of Sponsor shall be binding and final. If the properly executed documentation is not received within the specified time period, the selected entrant chooses to decline the prize for any reason, or fails to comply with these Official Rules, the selected entrant will be disqualified and another eligible entrant will be selected. Sponsor reserves the right to modify the notification procedures in connection with the selection of the alternate Sweepstakes entrant(s), if any. Except where prohibited by law, entry and acceptance of a prize constitutes permission for Sponsor to use winner's name, home town, likeness, statements and other personally identifiable information for advertising and marketing of Sponsor's products, services and consumer promotions in any media throughout the world without additional prize, incentive, consideration, consent or review; and upon request, winner will provide written consent to such use. 9. RELEASE AND DISCLAIMER OF LIABILITY: Sponsor, and Sweepstakes Entities are not responsible for 1) any error, omission, interruption, deletion, defect, delay in operations or transmission, theft, destruction or unauthorized access to or alterations of entry materials or any human errors; 2) for technical, network, telephone, computer, hardware or software malfunctions of any kind, or inaccurate transmission or processing of, or failure of Sponsor or agents to receive entry information on account of technical or any combination thereof; 3) any injury or damage to entrant's or any other's person or property resulting from participation in the Sweepstakes; 4) entries or mail that are late, lost, misdirected, illegible, damaged, or otherwise deficient. Sponsor reserves the right, in its sole discretion, to terminate, cancel, suspend or modify the Sweepstakes in its entirety, or any portion thereof if its integrity, fairness or proper operation is undermined, or corrupted as a result of technical or other reasons or because of any illegal or non-authorized intervention or any other factor beyond Sponsor's reasonable control. In that event, Sponsor may select the grand prize winner(s) from all eligible entries received prior to such modification or cancellation. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. By entering, participants (a) agree to be bound by these Official Rules and the decisions of the Sponsor and Administrator, which shall be without legal or other recourse and final in all respects; (b) release Sponsor and Sweepstakes Entities and their respective divisions, dealers, subsidiaries, affiliates, and advertising and promotion agencies, and their respective directors, officers, agents and employees from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize; and (c) acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize. By accepting a Prize, the winner and his/her travel companion represent that they understand that travel, whether by plane, automobile, or other method, contains some inherent element of risk of accident, illness, injury, loss or death, which may be caused by negligence, forces of nature, or other agencies, known or unknown. Winner and his/her travel companion represent that they recognize that such risks may be present at any time before, during and after the trip. In order to be considered a Prize winner, winner and his/her travel companion must be willing to accept the risk, and to confirm their acceptance to such risk in writing at Sponsor's request. 10. PRIVACY: Unless prohibited by law, information collected in connection with this Sweepstakes may be shared with Sponsor's promotional partners if and to the extent entrants agree at the time of entry, and in such event, the use of such information by such promotional partners will be used in accordance with such partners' respective privacy policies. Except as otherwise contemplated in these Official Rules, information collected in connection with this Sweepstakes will be used in accordance with Sponsor's privacy policy. DISPUTES: Entrants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Oakland County, Michigan, USA. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor and Sweepstakes Entities in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Michigan, USA. Any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorney's fees. 12. SWEEPSTAKES RESULTS AND OFFICIAL RULES: A list of the winners will be available after the winner has been verified and the prizes have been awarded.
